Terms & Conditions
§ 1 Scope
These General Terms and Conditions apply to all contracts between SellerScaling GmbH (Contractor) and its customers (Client). Deviating or supplementary terms of the Client shall only become part of the contract if the Contractor has expressly agreed to their validity in writing.
§ 2 Contract conclusion
Offers from the Contractor are non-binding. A contract is only concluded upon the Contractor's written order confirmation or the commencement of service provision.
§ 3 Scope of services
The scope of services to be provided results from the respective order confirmation or offer. Changes or extensions to the scope of services require a written agreement.
§ 4 Remuneration and payment terms
Remuneration is based on the agreed offer. Invoices are to be paid within 14 days of the invoice date without deduction. In the event of default, the Contractor is entitled to charge default interest of 9 percentage points above the base rate.
§ 5 Liability
The Contractor is only liable for damages in cases of intent and gross negligence. Liability for slight negligence is excluded to the extent permitted by law. This does not apply to damages resulting from injury to life, body or health.
§ 6 Jurisdiction and applicable law
German law shall apply to all disputes arising from this contractual relationship, excluding the UN Convention on Contracts for the International Sale of Goods. The place of jurisdiction is Berlin.
